This image is copyrighted. The copyright holder allows anyone to use it for any purpose, provided that it is used to propagate the memory of Ernesto 'Che' Guevara.

This is a photo portrait taken by the Cuban photographer Alberto Korda and printed with strong contrast. Cuba didn't sign the Berne convention, making the copyright status of the image unclear, until Korda successfully claimed copyright after filing suit in London to prevent its use in promotion of a Vodka product.

Korda's terms of reproduction for the image are as follows:

"As a supporter of the ideals for which Che Guevara died, I am not averse to its reproduction by those who wish to propagate his memory and the cause of social justice throughout the world, but I am categorically against the exploitation of Che's image for the promotion of products such as alcohol, or for any purpose that denigrates the reputation of Che."

It is believed that the use of the image on Wikipedia is acceptable within his terms.


Further comment: I have used this picture as an icon on the template for stub articles on South American biographies. For that is what this photograph is - an iconic image. As probably the single most recognisable image of any South American it is a perfect image for this template. Furthermore, by its use in this way, Che's memory will be further propagated - being seen whenever articles on South Americans are edited. Given the ethos of Wikipedia - that the site is non-commercial, egalitarian, and communal - I feel sure that its philosophy shares many things in common with that of Guevara himself. Viva! The license stipulates that the image may not be used to denigrate the reputation of Che. How do we know whether Korda would consider the truth as we see it to be a denigration? For instance, as of today, the Che Guevara article reads: "New York Sun writer Williams Myers labels Guevara a 'sociopathic thug'. Other critics writing in the U.S. press have made similar remarks. They assert that Che Guevara was responsible for the torture and execution of hundreds of people in Cuban prisons, and the murder of many more peasants in the regions controlled or visited by his guerrilla forces. Contrary to Guevara supporters, these critics argue that Guevara was a blundering tactician.'" Are we allowed to say that under this license? - Nat Krause( Talk!) 07:12, 12 April 2006 (UTC)
